GENERAL TERMS
The agreement on this page shall be valid and binding for you from the moment you start using the services of TURKNETHOST Internet Services, a registered trademark of Turkbim Bilişim ve İletişim Teknolojileri San. Tic. Ltd. Şti. (hereinafter referred to as “Turknethost”). Please read this agreement carefully before starting to use our services.
We offer four different product agreements for the services that can be purchased from www.turknethost.com, grouped under four main headings, taking into account the different terms applicable to each product group. Accordingly, the agreements accessible through the links above are as follows:
Why is membership required?
In order to purchase products from our website and manage the products you have purchased 24 hours a day, 7 days a week, you must have an account on www.turknethost.com to access the Customer Panel prepared for this purpose.
In addition, we send the latest announcements and product updates regarding our products and www.turknethost.com to the e-mail address or mobile phone number you provided during registration by e-mail or SMS.
General Membership Agreement
1-) Your information is absolutely not shared with third parties.
2-) Membership information must be provided accurately.
3-) Our company reserves the right to cancel your membership.
4-) Memberships containing information that does not reflect the truth shall be cancelled.
5-) Only one membership may be opened with each e-mail address.
6-) Memberships cannot be deleted for 5 years from the date of non-use, subject to the obligation to retain log records.
7-) You are deemed to have accepted receiving all kinds of advertising, warning, notification and information SMS and e-mails sent by us.
8-) Upon becoming a member, all agreements on the “Terms of Use Agreement” page are deemed to have been accepted.
9-) If there is suspicion that the membership was opened with false or irrelevant identity information, member login shall be blocked and identity verification shall be requested.
10-) Although this agreement may be written in different languages, due to possible errors and inaccuracies arising from translation, the Turkish version of the agreement shall prevail.

DOMAIN AGREEMENT
1. PARTIES
The Domain Registration and Transfer Agreement is accepted between Turkbim Bilişim ve İletişim Teknolojileri San. Tic. Ltd. Şti., operating at Selahattin Eyyubi Mah. 333. Sk. No:4/E Bağlar DİYARBAKIR (hereinafter referred to as turknethost.com), and the real or legal person purchasing products and services through the website www.turknethost.com under its control (hereinafter referred to as the CUSTOMER), under the terms detailed below.
2. EFFECTIVE DATE AND TERM OF THE AGREEMENT
2.1 Your electronic approval of this agreement means that you have read the agreement and accepted and agreed to all terms contained herein.
2.2 All disputes that may arise between the parties shall be resolved within the framework of the explanations detailed in this agreement. If the CUSTOMER violates the specified terms, turknethost.com may seize the relevant accounts or suspend the services temporarily or permanently.
2.3 This agreement enters into force between turknethost.com and the CUSTOMER after approval by the CUSTOMER. This agreement covers the rules and general service terms regarding domain registration and transfer services provided or to be provided by turknethost.com to the CUSTOMER.
3. DEFINITIONS
3.1 The CUSTOMER and turknethost.com accept that the CUSTOMER is the authorized party for all matters related to the allocated domain.
3.2 If the domain service is obtained by a legal entity, the authorized signatory of the company shall be deemed authorized for the domain.
3.4 The CUSTOMER accepts all rules determined or later amended by turknethost.com and/or the authorized registrar. Changes may be required in this agreement in order to comply with the rules and policies determined by ICANN or organizations appointed by ICANN as registrars. The CUSTOMER accepts that such changes may be made.
3.5 The service shall not be deemed completed until the domain is registered. For domains that cannot be registered, require documentation, are reserved, or are special/premium domains, turknethost.com may perform an unconditional refund and cancel the order.
4. FEES
If the services offered for sale by turknethost.com are requested by the CUSTOMER, the CUSTOMER agrees to make payment for the service. Payment shall be made by the CUSTOMER through one of the payment methods determined by turknethost.com. The payment methods determined by turknethost.com include online payment by credit card, PayPal payment system, bank transfer or EFT. Service fees may be determined in Turkish Lira or US Dollars. However, all payments shall be converted into Turkish Lira at the current exchange rate during the order stages and shall be paid in Turkish Lira. If, after the purchase of a domain registration service, turknethost.com cannot collect all or part of the fee related to the service, or if payment has been collected but is later refunded as a result of an objection, turknethost.com may apply all legal measures for collection of the payment. Where necessary, it may also suspend the CUSTOMER’s services temporarily or permanently. If the service was paid by a different person or institution and that person or institution claims to be the actual owner of the service, the domain shall be transferred to the person who made the payment. However, contents uploaded by the CUSTOMER shall not be transferred; only the service transfer shall be performed.
5. DOMAIN RENEWALS
Domain registrations are made for a period of 1 to 10 years according to the CUSTOMER’s preference. The CUSTOMER may extend the period if desired. Extension is made through the control panel by the CUSTOMER placing an order and making payment. turknethost.com is not obliged to perform or monitor domain renewal. turknethost.com sends warning e-mails or SMS messages to the e-mail address or mobile phone number notified by the CUSTOMER during registration. However, if these e-mails or SMS messages are not noticed or do not reach the CUSTOMER, turknethost.com shall have no liability. The CUSTOMER is responsible for monitoring the domain expiration date.
If the domain renewal fee cannot be collected from the CUSTOMER for any reason, the domain registered by turknethost.com shall become unavailable at the end of its term. A domain that becomes unavailable may be renewed and activated within 30 days upon the CUSTOMER’s request by extending its term. After 30 days, however, the domain enters the Redemption Period. If the CUSTOMER wishes to reclaim the domain during this period, the delay costs requested by ICANN shall be added and the expenses shall be collected. At the end of the Redemption Period, the domain enters the cancellation process. No renewal can be performed during this process. At the end of the process, the domain will become available for purchase by everyone again.
6. AGREEMENT TERM; CHANGES
This agreement shall remain valid as long as the CUSTOMER performs domain registration through turknethost.com. Pursuant to ICANN rules, a domain cannot be transferred to another company for 60 days from registration and renewal. turknethost.com may make changes to this agreement from time to time in accordance with laws and international domain rules. The CUSTOMER is deemed to have accepted such changes and updates. If the CUSTOMER wishes to terminate this agreement unilaterally, the CUSTOMER accepts that no refund shall be received.
7. CURRENT CUSTOMER INFORMATION; USE OF INFORMATION AND EXPIRATION
The CUSTOMER must keep the information provided as part of the services accurate and up to date. In case of any change in information, the CUSTOMER must make the changes through turknethost.com. For any reason, if the information provided by the CUSTOMER to turknethost.com is not accurate, the agreement shall be deemed violated. In suspicious cases, turknethost.com has the right to request updated information from the CUSTOMER. If such information is not provided, turknethost.com has the authority to suspend and cancel the services. The CUSTOMER accepts that the contact information provided during domain registration may appear on the internet in accordance with registrar rules. The CUSTOMER cannot hold turknethost.com responsible for such information visible to everyone on the internet.
For each domain registered by the CUSTOMER, the following information shall appear in Whois services in a manner visible to everyone in accordance with international domain policies. The CUSTOMER is deemed to have accepted that third parties may access and commercially use such information as a result of internet queries.
8. DISPUTE RESOLUTION POLICY
The CUSTOMER is deemed to have accepted the “Dispute Resolution Policy” arranged by turknethost.com within the framework of international domain rules. turknethost.com may change these rules when necessary. The CUSTOMER accepts that, while receiving service, the agreements on the turknethost.com website should be read periodically in order to review changes in resolution rules. If the CUSTOMER wishes to cancel the domain registration due to these changes, no refund shall be made.
9. DOMAIN TRANSFER PROCEDURES
The CUSTOMER may transfer any domain to another person through the turknethost.com website or through the CUSTOMER representative. Once the transfer is completed, the domain cannot be taken back or its operation interfered with. The CUSTOMER performs the transfer after investigating and confirming all risks beforehand. turknethost.com cannot be held responsible for disputes arising after transfer. A domain may be transferred to another registrar only by means of a transfer code. After the domain is transferred to another company, turknethost.com shall have no responsibility over the relevant domain.
10. SUSPENSION OF SERVICES; BREACH OF AGREEMENT
The CUSTOMER accepts all rules determined by turknethost.com or the authorized registrar. In case of non-compliance with the rules specified in the agreements, turknethost.com has the right to suspend, put on hold, or cancel the service.
11. RESTRICTION OF SERVICES; RIGHT OF REFUSAL
Any domain sold by turknethost.com cannot be cancelled in any way after the sale is completed. No change can be made to the domain name. No refund shall be made in any way.
The CUSTOMER receiving domain services accepts and undertakes not to use the service, or allow others to use it, for the purposes specified below.
12. UNSOLICITED E-MAIL SENDING (SPAM)
12.1 Performing high-volume or repeated operations on services provided by turknethost.com (such as domain queries).
12.2 Mail bombing, destination address abuse, packet corruption, internet packet flooding and similar uses.
12.3 Illegal access to servers, damaging or accessing systems by exploiting security vulnerabilities.
12.4 Attempts constituting legal offences such as defamation, harm, threat, harassment and similar acts against any person or institution.
12.5 Offences defined under Law No. 5651.
12.6 Terror and hate crimes, child pornography content or links to such content.
12.7 Attempts to impersonate another person.
12.8 Content contrary to public morality.
turknethost.com may take all kinds of measures such as suspension or cancellation of domain service in such cases. No refund shall be made for the domain fee due to breach of agreement.
HOSTING AGREEMENT
1. PARTIES
The Hosting Services Agreement is accepted between Turkbim Bilişim ve İletişim Teknolojileri San. Tic. Ltd. Şti., operating at Selahattin Eyyubi Mah. 333. Sk. No:4/E Bağlar DİYARBAKIR (hereinafter referred to as turknethost.com), and the real or legal person purchasing products and services through the turknethost.com website under its control (hereinafter referred to as the CUSTOMER), under the terms detailed below.

2.1 Electronic approval of this agreement means that you have read, accepted and agreed to all terms contained herein.

2.3 This agreement enters into force between turknethost.com and the CUSTOMER after approval by the CUSTOMER. This agreement covers the rules and general service terms regarding hosting services provided or to be provided by turknethost.com to the CUSTOMER.
3. DEFINITIONS
3.1 The service provided by turknethost.com to the CUSTOMER is the publication of websites or databases on servers whose infrastructure is provided by turknethost.com. The CUSTOMER may purchase Reseller Hosting, Web Hosting or Database services separately or together. By purchasing these services, the CUSTOMER is deemed to have accepted all terms contained in this agreement.
3.2 Subject to the provisions of the agreement, turknethost.com is obliged to provide the relevant service in the best possible manner. The CUSTOMER accepts that problems may occur in accessing the services. Problems that may cause interruption include force majeure events such as natural disasters and war, hardware failures, interruptions that may occur during maintenance, internet line interruptions, and interruptions during malicious attacks.
3.3 The CUSTOMER accepts that problems may occur regarding the services provided by turknethost.com.
3.4 turknethost.com shall make its best effort to ensure continuity of services provided to the CUSTOMER.
3.5 turknethost.com may suspend and inspect the services it provides.
3.6 SSL certificates are used together with a specific domain and service, such as hosting, server or e-mail. SSL services sold by turknethost.com or another company operate only in connection with a specific domain and service and are specially designed. It may not be possible to move the SSL to another company or service. The CUSTOMER must keep and back up the private key of an SSL certificate running on a website hosted on turknethost.com servers. The CUSTOMER cannot request the private key from turknethost.com when moving to another server. This operation is performed with the private key backed up by the customer. turknethost.com shall not be responsible for technical problems that may occur during SSL certificate migration.
3.7 Within the scope of Reseller Hosting, turknethost.com grants the CUSTOMER the right to sell to third parties. The CUSTOMER is responsible for support requests made by third parties for services provided under the reseller hosting package. turknethost.com provides technical support only to the CUSTOMER. The CUSTOMER is responsible for the content within the reseller hosting package. In any legal investigation, turknethost.com shall provide requested contact information or log records to judicial authorities or law enforcement.
4. OBLIGATIONS OF THE CUSTOMER
4.1 The CUSTOMER may not engage in conduct or publications aimed at damaging the commercial reputation and respectability of turknethost.com. If such attempts are detected, turknethost.com has the right to terminate the agreement.
4.2 By accepting this agreement, the CUSTOMER agrees not to publish content contrary to laws, regulations, rules, public morality and etiquette. The CUSTOMER is responsible for its own content and the content of its sub-customers. In case of non-compliance, turknethost.com may suspend the services or delete them completely from its systems. No refund shall be made in such cases contrary to the agreement.

Even if not explicitly listed, activities that are illegal or known as crimes are prohibited. Otherwise, turknethost.com reserves the right to terminate the agreement.
4.3. Resource Usage
The CUSTOMER agrees that resources of the system used for the service cannot be used at 100% or more for 180 seconds or longer. Sites continuously using 100% resources shall be hard-limited to 25% CPU. Unlimited hosting packages are limited to 100,000 inodes. Content unrelated to the website cannot be stored. Personal content cannot be stored under image, video or music galleries. Services cannot be used for archiving. Share-oriented files such as .zip, .rar, .tar, .gz etc. cannot be hosted. Database services cannot be used as remote servers.
4.4 Bandwidth Usage
Even if the monthly bandwidth available to the CUSTOMER is unlimited, the server and infrastructure have limits. Access problems may occur when these limits are reached.
4.5 turknethost.com makes necessary efforts to back up and publish all data of the CUSTOMER securely. However, it cannot be held responsible for problems that may arise. Backing up data is the CUSTOMER’s own responsibility. The CUSTOMER is obliged to protect account passwords and the e-mail address to which passwords are sent. turknethost.com cannot be held responsible for damages resulting from passwords falling into the hands of others.
5. PAYMENT
5.1 The CUSTOMER is always obliged to pay in advance for services purchased from turknethost.com. If payment is not made, turknethost.com has the right to terminate the service.
5.2 If the CUSTOMER makes payment to bank accounts, the order number must be entered in the description field. Otherwise, turknethost.com cannot determine which service the payment relates to and shall not be liable for damages arising from this.
5.3 Hosting and reseller hosting services shall be suspended if 7 days pass after the service period ends. After 30 days, they shall be permanently deleted from the systems. turknethost.com cannot be held responsible for damages arising from this.
6. TERMINATION OF THE AGREEMENT
turknethost.com may change the articles of the agreement at any time. As long as the CUSTOMER continues to receive service, the CUSTOMER is deemed to have accepted that such changes may be made. If the CUSTOMER acts contrary to the rules contained in turknethost.com agreements, turknethost.com may suspend the services provided to the CUSTOMER without notice. In this case, no refund shall be made.
SERVER AGREEMENT
1. PARTIES
This agreement is accepted between Turkbim Bilişim ve İletişim Teknolojileri San. Tic. Ltd. Şti., operating at Selahattin Eyyubi Mah. 333. Sk. No:4/E Bağlar DİYARBAKIR (hereinafter referred to as turknethost.com), and the real or legal person purchasing products and services through www.turknethost.com (hereinafter referred to as the CUSTOMER), under the terms detailed below.
2. EFFECTIVE DATE AND TERM OF THE AGREEMENT
2.1 Electronic approval of this agreement means that you have read and accepted all terms contained herein.
2.2 All disputes shall be resolved within the framework of the explanations detailed in the agreement. If the CUSTOMER violates the terms, turknethost.com may seize the relevant accounts or suspend services temporarily or permanently.
2.3 This agreement enters into force after approval by the CUSTOMER and covers the rules and general service terms regarding the services provided or to be provided by turknethost.com to the CUSTOMER.
3. SERVICE DETAILS
The services to be provided by turknethost.com to the CUSTOMER under this agreement include the leasing of physical servers belonging to turknethost.com (Dedicated or Rental Server), VPS or VDS servers, and server colocation services.
4. SERVICE OBLIGATIONS
4.1 After the customer makes payment, the service is activated and the information is sent to the customer. Activation may be online, while special installation cases may require a 24–48 hour setup period.
4.2 turknethost.com cannot be held responsible for access problems arising from internet line interruptions, slowdowns or similar problems outside its control.
4.3 After turknethost.com activates the service, it cannot be held responsible for problems that may occur in the software and hardware used on the server.
4.4 Backup responsibility on servers belongs to the CUSTOMER. turknethost.com cannot be held responsible for any data loss for any reason.
4.5 Unless it is stated that software licences are covered by turknethost.com, the CUSTOMER is responsible for all software licences. The CUSTOMER is responsible for compensation for all damages to third parties.
4.6 The CUSTOMER is responsible for the content on the servers. Upon requests or notifications by courts, prosecutors, BTK or law enforcement, turknethost.com may suspend the service if it deems necessary.
4.7 In rental server and VDS/VPS services, turknethost.com is responsible for hardware problems. Part replacement shall be performed as soon as possible depending on part availability.
4.8 Server support shall be provided within the scope of server support packages. Unless otherwise stated, server management is the CUSTOMER’s responsibility. turknethost.com delivers the server in working condition. After management passes to the CUSTOMER, the CUSTOMER shall be responsible for problems caused by incorrect configuration, file deletion, file modification, harmful content, malware and similar user-related errors. turknethost.com may resolve problems for a fee according to the server support price list or perform a new installation for a fee.
4.9 Even if the server belongs to the CUSTOMER, the CUSTOMER may not send unsolicited e-mail (SPAM) or perform phishing. Even if this is done outside the CUSTOMER’s control, turknethost.com has the right to suspend the service without notice when necessary.
4.10 Content that cannot be hosted under server services is listed below.
5. FEES AND COLLECTION
5.1 turknethost.com notifies the customer by e-mail of the amounts to be collected for the service.
5.2 Upon acceptance of the service by the CUSTOMER, turknethost.com is authorized to collect payment.
5.3 If renewal payments are not made on time, turknethost.com may suspend the service. turknethost.com is not responsible for damages resulting from suspension.
5.4 turknethost.com issues invoices for the services provided. Invoices can be downloaded through the CUSTOMER panel.
5.5 If service renewal is not made, the service shall be permanently deleted from the systems on the 7th day after the service expiration date. turknethost.com shall not be responsible for damages arising from deletion.
6. TERMINATION OF THE AGREEMENT
6.1 Changes that may occur over time in this agreement approved by the CUSTOMER during online application shall be published on the website and/or notified to the CUSTOMER by e-mail. By continuing to use turknethost.com services, the CUSTOMER shall be deemed to have accepted the amended terms.
6.2 If payments are not made or are delayed in any way, turknethost.com reserves the right to terminate the agreement.
6.3 If the rules specified in the agreement are not complied with, turknethost.com shall terminate the agreement. No refund shall be made.
GENERAL SERVICE AGREEMENT
THE GENERAL PROVISIONS OF THIS SERVICE AGREEMENT CONTAIN IMPORTANT INFORMATION REGARDING LEGAL RIGHTS AND OBLIGATIONS.
1. PARTIES
This agreement is made between Turkbim Bilişim ve İletişim Teknolojileri San. Tic. Ltd. Şti., operating at Selahattin Eyyubi Mah. 333. Sk. No:4/E Bağlar DİYARBAKIR (hereinafter referred to as turknethost.com), and the real or legal person whose information is obtained through the relevant form on www.turknethost.com by purchasing products and services of turknethost.com (hereinafter referred to as the CUSTOMER), under the terms stated below.
Your electronic acceptance of this Agreement means that you have read, understood, agreed to and accepted that this Agreement and the corporate policies and/or agreements referenced herein and published on the turknethost.com website are binding upon you. The Privacy Policy is the policy setting out the principles regarding privacy rules announced at http://www.turknethost.com/hizmet-ve-kullanim-sozlesmesi. In this Agreement, the terms “we”, “us” or “our” refer to turknethost.com. The terms “you”, “your”, “Customer” or “User” refer to all persons or entities accepting this Agreement. turknethost.com may, solely and absolutely at its own discretion, change or renew this Agreement and the corporate policies and/or agreements incorporated herein at any time. Such changes or renewals shall become effective immediately as of the date of the e-mail notice or the date they are published on the website, namely the “Last Revision Date”.
2. CONDITIONS FOR BENEFITING FROM THE WEBSITE SERVICES
This Website and the Services available on it may only be used by persons who are legally capable of entering into binding agreements under applicable laws. By using this Website and the services on it, you represent and warrant that you are at least eighteen (18) years old and/or otherwise have the legal capacity to enter into binding agreements under applicable laws. If you enter into this Agreement on behalf of any corporate entity, you represent and warrant that you have the legal authority to bind such corporate entity to the terms of this Agreement. In that case, the terms “you”, “your” or “User” refer to such corporate entity. If, after your electronic acceptance, turknethost.com determines that you did not have legal authority to bind the corporate entity, you shall be personally responsible for the obligations under this Agreement, including payment obligations. turknethost.com shall not be responsible for any loss or damage arising from reliance on instructions, notices, documents or similar communications that reasonably appear to be authentic and issued by an authorized representative of your corporate entity. In case of reasonable doubt regarding authenticity, turknethost.com may request confirmation, but this is not an obligation of turknethost.com.
3. ACCOUNTS; TRANSFER OF DATA
3.1 Customer Account: In order to access certain features of this Website or use certain Services, you may be required to create an account (“Account”, “Customer Account”, “Membership”). You represent and warrant that all information provided to turknethost.com when creating your Account is accurate, current and complete, and that you will keep such information accurate, current and complete. If turknethost.com determines that your Account information is false, inaccurate, expired or incomplete, it reserves the right, at its sole discretion, to suspend or terminate your Account. You shall be responsible for all activities occurring in your Account, whether authorized by you or not, and you must keep your Account information confidential, including customer number/login ID, password, payment method(s) and security information. In case of any security breach or unauthorized use of your Account, you must immediately notify turknethost.com. turknethost.com shall not be responsible for any loss you may incur due to unauthorized use of your Account; however, you may be held responsible for damages caused to turknethost.com or third parties due to use of your Account. Individual memberships belong to a single person and may be managed only by the person registered with the Turkish ID number stated in the user information.
3.2 Data Transfer: By accepting that all information provided when creating your Account is accurate, current and complete and that you will keep it so, you accept, represent and warrant that turknethost.com may share all your information with domestic or foreign law enforcement, prosecutors, courts and other authorities upon requests received or that may be received. You also accept that all information and documents you provided to turknethost.com at and after account creation may be provided to the requesting persons or institutions and that you shall have no claim due to any erroneous notification arising from technical failures. Free services obtained from turknethost.com may be closed at any time by turknethost.com. The CUSTOMER cannot claim any right or compensation regarding free services that are closed or terminated.
3.3 Internal Service Transfer: turknethost.com offers internal transfer/service assignment in certain Services. For individual Customers, the service to be transferred is selected from the Customer Account and an internal transfer request is initiated by specifying the existing customer’s Turkish ID number and the customer number/membership to which the transfer will be made. The transfer initiator receives a transfer confirmation notice at the authorized e-mail address registered in the system. With the approval of the existing customer, the request is notified to the receiving customer. The transfer is completed when the receiving customer approves the request through the Customer Account. Transfer requests not approved by both parties within fifteen (15) days are automatically cancelled. In both individual and corporate accounts, turknethost.com primarily accepts the customer name, surname and address information in the invoice details as the real customer information. In corporate accounts, the full commercial title and address of the institution in the invoice details shall be accepted as the real customer information. If customer number/membership name and passwords are shared with third parties and such third parties represent themselves as the customer to turknethost.com, its employees or remote support team, turknethost.com cannot be held responsible for fulfilling such requests. turknethost.com does not guarantee whether an account is suitable for transfer, whether transfer is possible, or the time required to complete a transfer, and shall not be responsible for disputes arising from transfer.
4. GENERAL RULES TO BE COMPLIED WITH
The Customer shall use this Website, the Services and all content provided through them in accordance with this Agreement and all applicable national and international laws, regulations and rules. The Customer shall not access the site under another user’s or entity’s identity without prior written permission, shall not collect or use confidential or private information of other users or persons, and shall not use the Website, Services or content in any manner constituting offences under Law No. 5651, the Turkish Criminal Code, offences against honour, property-related offences, or other illegal activities.
